1. Acceptance of Terms

By accessing or using NovaBeat ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

NovaBeat is a generative audio-visual web application that transforms audio input into real-time visual art. The Service analyzes audio through your browser's microphone to generate dynamic visual effects. All audio processing occurs locally in your browser.

3. Account Registration

To use NovaBeat, you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activities that occur under it. You must notify us immediately of any unauthorized use.

4. Plans and Pricing

NovaBeat offers two tiers of service:

• Free Plan — includes access to a limited set of visual modes, snapshot export (PNG), full-screen mode, and theme switching. Free forever, no credit card required.
• Premium Plan — includes access to all 20+ visual modes, auto-slideshow mode, and priority support. Billed monthly through Lemon Squeezy.

Prices are subject to change. We will notify existing subscribers of any price changes at least 30 days in advance.

5. Cancellation and Refunds

You may cancel your Premium subscription at any time. Upon cancellation, you will retain Premium access until the end of your current billing period. After that, your account will revert to the Free Plan.

Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us at hello@novabeat.app within 14 days of the charge.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the Service.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Use automated tools, bots, or scrapers to access the Service without our prior written consent.
• Resell or redistribute the Service or any part of it.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Intellectual Property

All visual effects, designs, code, and branding associated with NovaBeat are the intellectual property of NovaBeat. You may not copy, reproduce, or distribute any part of the Service without our express written permission.

Snapshots (PNG exports) generated through the Service are licensed for your personal, non-commercial use. You may share snapshots on social media or personal projects with attribution to NovaBeat.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. Visual output may vary depending on your device, browser, and audio input.

9. Limitation of Liability

To the maximum extent permitted by law, NovaBeat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes by posting a notice on our website. Continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
